Application Requirements
All applicants for a Basic Business License must comply with the following DC Code requirements:
 
Corporate Registration
If your organization is a corporation, limited liability company, partnership, or in some cases, a trust, said organization must be registered and in good standing with the Corporations Division. Non-Resident of the District of Columbia (including Foreign Corporations)
If you are not a resident of the District of Columbia, you'll need to appoint a Resident Agent or an Attorney-in-Fact who lives or works in an office in the District, who will be the official recipient of any financial, process, or legal notices that we need to send to you. If you are not a DC resident, please complete the Certified Resident Agent Appointment Form.
 
Corporate Registered Agents
Any business required to register with the Corporations Division is required to maintain a registered agent. Said registered agent may be a bona fide District of Columbia resident or a company physically located in the District of Columbia. The registered agent’s office may or may not be the same address as the place of business.
 
Resident Agents
Family trusts, general partnerships, and sole proprietors are required to maintain a resident agent. Said resident agent may be a bona fide District of Columbia resident or a company physically located in the District of Columbia. The resident agent’s office may or may not be the same address as the place of business.
 
Trade Name Registration (Use of Fictitious Business Name)
A business operating under a fictitious name or a name other than the legally recognized name must register the trade name with the Corporations Division. Basic Business License Application
All applicants for a Basic Business License must complete an application, remit the associated payment, and submit the required supporting documentation.

Clean Hands Self-Certification
All applicants must certify that no more than $100 is owed to the District of Columbia Government as a result of fees, penalties, interest, or taxes through completion of a Clean Hands Self-Certification.
 
Tax Number
All Applicants must provide a registered tax number (i.e., SSN or FEIN) at the time of application. Register by completing and filing a Combined Business Tax Registration Application (Form FR-500) with the Office of Tax and Revenue, 1101 4th Street, SW, Suite W270, Washington, DC 20024. Certificate of Occupancy
All applicants for a Basic Business License operating from a premise located in the District of Columbia must provide a Certificate of Occupancy (C of O) for the premise address from which the business activity is conducted in order to demonstrate the activity does not conflict with building and zoning codes. Note: In some cases, a business operating in an office building may operate under the umbrella of the C of O issued to the owner of the building as long as the C of O is issued for the entire building. Check with the building owner or management company for the holder’s name, C of O number, and issue date.
 
Certificate of Garage Keeper's Legal Liability Insurance
All applicants for a Basic Business License for the Tow Truck Storage Lot category shall furnish a Garage Keeper's Legal Liability Insurance Policy for the license period pursuant to DC Code and DC Municipal Regulations. Each applicant must secure an original all-risk or public liability insurance policy, which provides a minimum of fifty thousand dollars ($50,000) in full force and effect for the duration of the license period per DC Code and DC Municipal Regulations. The licensee is required to give written proof of advance notice to the Department of Consumer and Regulatory Affairs, Business Licensing Division prior to the cancellation or lapse of the policy.
 
Note: The Certificate of Liability Insurance must: 1) be issued to your organization as registered with the Corporations Division; 2) be issued to the premise address provided on the Basic Business License Application; 3) provide a Description and Location of services provided (i.e., Tow Truck Storage Lot in Washington, DC); and 4) show the certificate holder as "Department of Consumer and Regulatory Affairs, 1100 4th Street SW, 5th Floor, Washington, DC 20024.”
 
P.O. Boxes are not acceptable as the insured’s premise address.
 
Copy of Deed, Lease, Contract or other Proof of Right to Use Storage Lot
All applicants for a Basic Business License for the Tow Truck Storage Lot category must submit a copy of a deed, lease, contract, or other proof of the right to use the space as vehicle storage lot.
 
Surveyor’s Plat
All applicants for a Basic Business License for the Tow Truck Storage Lot category must submit a copy of the site plan or Surveyor’s Plat may be obtained from the Surveyor’s Office, (202) 442-4566, 1100 4th Street S.W., 2nd Floor, Washington, DC 20024.
 
Additional Requirements for Surveyor’s Plat
If any other tow truck business occupies the same tow truck storage lot for the storage of towed vehicles, one surveyor’s plat with clear delineation of boundaries named and marked for each tow truck business shall be submitted along with the application for licensure. Tow truck businesses may not occupy the same space on a tow truck storage lot. The vehicle storage capacity for each business using the storage facility should be indicated.
 
Tow Service Storage Lot Supplemental Application
All applicants for a Basic Business License for the Tow Truck Storage Lot category must submit a Tow Truck Storage Lot Supplemental Application.

Daily Storage Fees
All applicants for a Basic Business License for the Tow Truck Storage Lot category must provide a list of the minimum and maximum daily fees which the applicant will charge for the storage of disabled motor vehicles at the applicant’s storage facility.
 
Hours of Operation
All applicants for a Basic Business License for the Tow Truck Storage Lot category must provide a statement detailing the location, description, and hourly availability of the tow truck.

Letter Listing Ownership Interest
All applicants for a Basic Business License for the Tow Truck Storage Lot category must provide a list containing the name, address, and telephone number of each individual, partner, and/or each officer of a corporation with an ownership interest in the towing business and storage service lot.
 
Tow Truck Storage Location
All applicants for a Basic Business License for the Tow Truck Storage Lot category must provide the primary storage location, year, make, model, Vehicle Identification Number (VIN), and license plate number of each tow truck that will be used by the towing business.
 
Towing Fees
All applicants for a Basic Business License for the Tow Truck Storage Lot category must provide a schedule of minimum and maximum fees which the applicant will charge for the use of the tow truck in connection with providing various kinds of towing service, together with a full and detailed statement of the service to be rendered for each stated amount of fee.
 
General Operational Requirements
A tow truck storage lot must comply with the following:
  • The tow truck storage lot shall be located on a secured lot in the District of Columbia, with appropriate signage, and be in full compliance with all District of Columbia laws, regulations, including zoning regulations. A secured lot is a lot secured at least by a six (6) feet chain link fence capable of being locked.
  • The Basic Business License holder shall maintain a log of all vehicles towed to and from its location. The operator shall maintain a log and make it available for inspection by Department of Consumer and Regulatory Affairs investigators.
  • The Basic Business License holder shall apportion the lot into storage lot sections and clearly identify or designate the towing business responsible for each apportioned section.
  • The Basic Business License holder shall employ reasonable procedures and requirements to ensure that vehicles are released to rightful owners or other authorized individuals.
  • The Basic Business License holder shall conspicuously post, at each tow truck storage lot, the Owner’s Bill of Rights for Towed Vehicles statement issued by the Director of Department of Consumer and Regulatory Affairs; and upon release of the vehicle, shall provide a copy of this statement to the person to whom the vehicle is released.
Investigation/Approval
This category of the Basic Business License is subject to a thirty (30) day background investigation prior to issuance of a license. This investigation will be conducted after a Basic Business License Application, all required supporting documentation, and payments have been received and accepted by the Business Licensing Division.

No appointments are required. Applications are processed on a first-come, first-served basis.
 
Via Mail.
You may apply for a Basic Business License and pay with a check or money order via mail. Please submit all requirements including the associated fee. Make check or money order payable to “DC Treasurer.”
